The Commission deemed it must-read to direct Local Government Units (LGUs) to use the position titles under RA 7160 for Department Heads positions and not the generic Provincial/City/Municipal Government Department Head. The Commission noted that LGUs interchangeably used the parenthetical position titles of Provincial/City/Municipal Government Department Head in lieu of LGU Department position (i.e. Secretary to the Sanggunian, Treasurer, Assessor, Accountant, Budget Officer, Planning Development Coordinator, Engineer, Health Officer, Civil Registrar Administrator, Legal Officer, Agriculturist, Social Welfare and Development Officer, Environment and Natural Resource Officer, Architect, Information Officer, Cooperative Officer, Population Officer, Veterenarian, General Service Officer, etc.). However, said positions have different qualification standards. Some Department Head positions are even considered as practice of profession, which requires appropriate professional license (RA 1080).
The Commission deemed it must-read to inform/remind all the agencies that it cannot restore an appointee to his/her former position if his/her case is still pending before the Commission for resolution. The agency, by itself, cannot determine the validity or invalidity of an appointment and impose the necessary effects of disapproval/invalidation/revocation of an appointment such as restoration to former position. In case the concerned agency prematurely restored the appointee to his/her previous position, he/she should be paid the salary of the position, subject of the disapproved/invalidated appointment case, from the time of appointment until the actual execution of the Commission’s Decision/Resolution.
